Probate Estate Planning

If you have recently experienced the loss of a loved one, you may be responsible for managing their estate. Probate is the process of administering the estate of the deceased with court supervision. We handle the probate process from start to finish, including preparing court filings, appearing in court, distributing proceeds, paying debts of the estate, and executing the wishes of loved ones.

Divorce

At Darling / Duffy, we are compassionate in our representation and experienced in dealing with the needs of our clients during stress-filled times like separation from your spouse and the court process leading to divorce.

Elder Law Planning

People are living longer, but we all need help making our hard-earned life savings last as long as we do. If you, or a loved one, is facing the prospect of long-term assisted or nursing care with only moderate income and assets to pay for it, Medicaid may be needed to fund part or all of the cost of care.

However, Medicaid will only pay for that nursing care after your life’s savings are gone. Most nursing home residents enter a facility on a private basis and only later turn to the Medicaid program for coverage. In this way, many spend their savings, retirement, and sell their property to finance their stay. Through appropriate planning, we work with clients to get them qualified for Medicaid sooner and keep their assets for themselves and their families.
